Functional Lab Testing and Scope of Practice Webinar

We designed this webinar so that you can better understand the bounds of scope of practice issues and the state laws that will apply to your practice in the context of functional lab testing so that you can operate your practice without fear or reservation that you are breaking the law. Exceeding your scope of practice or not complying with state laws can have negative consequences, including fines, prohibitions from practicing, and even jail time (although unlikely). Being aware of the parameters in which you can legally operate and adjusting your practice accordingly will ensure that you can leave behind any fears that you are breaking the law and instead focus on serving your clients.

These laws and scope of practice issues are incredibly complex (and even more complex given there are 50 different states to consider), so this webinar will give you a crash course on important topics you need to understand as an unlicensed health, wellness, and/or nutrition practitioner if you are utilizing (or thinking about utilizing) functional lab testing in your practice. Kristin and Kelly spent countless hours researching these laws and creating this presentation for you. We feel strongly that scope of practice issues and state nutrition laws are a vital part of the equation for every health, wellness, and nutrition professional that is often overlooked – leading to unnecessary legal risk. This webinar was designed to educate unlicensed health, wellness, and nutrition professionals on scope of practice issues and state nutrition laws as it relates to utilizing functional lab testing in their practices. In particular, it was designed for health, wellness, and nutrition practitioners utilizing functional lab testing in their practice, especially those with the following types of certifications:

• Health and Wellness Coaches
• Nutritional Therapy Practitioners
• Functional Diagnostic Nutrition Practitioners
• Root Cause Protocol Consultants
• Restorative Wellness Practitioners
• Other wellness practitioners that may give nutrition-related advice to clients and utilize functional lab testing in their practice(such as Fertility Awareness Educators, Fertility and Prenatal Coaches, Fitness Professionals, etc.)
• Certified Nutrition Specialists and Certified Clinical Nutritionists will also find helpful information in this webinar, as we go over examples of laws in certain states that only permit Registered Dietitians who are licensed in that state to provide nutrition-related care

• We also address common questions such whether the type of testing matters in the scope of practice analysis (i.e., is blood testing different than saliva, hair, urine, or stool testing?). 
• We also help walk you through some practical considerations and possible risk mitigation strategies if you utilize functional lab testing in your practice. 
• Finally, we also provide a DIY template paragraph that can be inserted into contracts in the one-on-one setting, the group coaching setting, and the course/membership setting that addresses utilizing functional lab testing. 

Please note that it would be impossible to cover all 50 state statutes and laws concerning functional lab testing in one presentation, so although we will go through examples of a couple of different states to teach you how to look at a statute, we will not cover all 50 states in this presentation. Further, since state laws are always subject to change, it is better for you to have knowledge of how to find the applicable statutes, and we recommend following up for changes in your state’s statutes often. Please note that we will give you tips on how to locate statutes that would apply in all 50 states.
